Booking Terms & Conditions

theGCexperience Ltd., organizes and hosts day retreats, experiences and services as described on www.theGCexperience.com website. Please read them carefully as you will be bound by these terms. By registering and paying, you are agreeing to the Terms and Conditions which governs the relationship, conflict resolution, cancellation policy and limitations of liability of theGCepxerience Ltd..

These Terms and Conditions shall constitute as the agreement between theGCexperience Ltd. (the “theGCexperience”) and the Client relating to the subject matter herein and shall constitute a binding agreement. This Agreement may be supplemented by additional terms and conditions specific to your Journey (“Supplemental Terms”). In the event of a conflict between this Agreement and the Supplemental Terms, the Supplemental Terms will take precedence.

PRICING AND INCLUSIONS

Prices are per person, quoted and payable in Canadian (CDN) dollars. HST tax (13%) is subject to all sales as required by the Government of Canada.

Prices include programming, planning, handling, and operational charges and are based on current rates of exchange, tariffs, and taxes in effect at the time of publication. We reserve the right to increase our prices to cover increased costs, tariffs, taxes etc. received after prices are published and to reflect fluctuations in foreign exchange markets. We will not give a breakdown in the price of a Journey or its parts however we will remain transparent, clients will be notified in writing.

theGCexperience is not responsible for any fees incurred due to currency exchange or fees charged by your credit card/bank for processing funds in another currency.

RESERVATIONS AND PAYMENTS

Upon receipt of your payment, you will receive a confirmation of your booking with exact address of our location. Because we work from our home, we are careful of who we share our address with.

  • Payments can be made on our secure website, by Email Money Transfers (EMT) or by cash. Our preferred method of payment is EMT and cash.

  • Payment Plans: All requests must be sent in writing to gen@theGCexperience.com

For out of country retreats: final payment date will be listed on the confirmation. Final payment is due thirty (30) days prior to the retreat unless otherwise specified. If your reservation is made within thirty (30) days of departure, the entire cost of the retreat must be paid at the time of booking in order to secure confirmation. Participation will not be permitted if an unpaid balance remains. No refunds will be provided. Credits to be used towards a future experience may be offered at the sole discretion of theGCexperience depending on the circumstances minus the security deposit.

If an experience is sold out, we will accept deposits on a standby basis. If space becomes available, you will have the choice of joining the experience by paying in full or forfeiting the space in return for a refund of your deposit.

CANCELLATIONS BY THE CLIENT

We understand that unexpected events can arise. If you need to cancel or reschedule your appointment we ask that you provide 24 hours notice. While we understand that this is not always possible, we reserve the right to charge you in full when 24 hours notice is not provided.

In the event sickness, or contact with someone who is sick, we will waive any late cancellation fee providing the appointment is cancelled more than 3hrs prior to your visit.

theGCexperience primary objective remains the Client’s satisfaction. Should the Client cancel outside of our cancellation period AND the experience is sold out, theGCexperience will do its best to find a replacement through our waiting lists.  Should the experience not be sold out upon receipt of the cancellation notice, theGCexperience will try to find a replacement once all other spots have been filled.

For out of country retreats: Although not mandatory, we strongly recommend all our guests to purchase travel & cancellation insurance to protect their purchase. All cancellation requests must be received in writing at GCjourneybegins@gmail.com, as soon as possible. Cancellations received:

  • over ninety (90) days prior to the retreat = Partial refund. Total amount paid minus non-refundable deposit and $100 administration fee.

  • within ninety (90) days prior to the retreat = 100% of monies paid will be non-refundable. Should a replacement be found, theGCexperience will be more than happy to refund all moneys paid minus the non-refundable security deposit and $100 administration fee. Should The Client find their own replacement, 100% value of moneys paid, minus the non-refundable security deposit, will be transferred to the replacement guest. The replacement will pay the remaining balance owing to theGCexperience (when applicable). In the event that you find your own replacement, the original Client and the replacement will make arrangements between themselves for any monies already paid and the replacement will make arrangement immediately for paying any balance due. No administration fees will be charged.

Any penalty imposed by an airline, including for airline service between points on the Journey (“Internal Air”), is The Client’s responsibility.

Your decision not to participate on the experience or any of its activities due to Government warnings, fear of travel, illness or any other reason will be treated as a cancellation. If a flight or other delays prevents you from joining the Journey on the departure date and time, you will be considered a no-show. In these cases, no refunds will be issued. theGCexperience encourages the Client to obtain travel insurance immediately upon booking any of our Journeys to ensure they have coverage in the case of an unforeseen event.

CANCELLATIONS BY THEGCEXPERIENCE

We reserve the right to cancel an experience for any reasons including inadequate enrollment that makes the Journey economically infeasible to operate OR because of our concerns with respect to the safety, health or welfare of our Clients or staff.

theGCexperience will not cancel an appointment less than 3 days before (except for Force Majeure, unusual or unforeseen circumstances outside the theGCexperience control. "Force majeure" describes uncontrollable events such as but not limited to war, labor stoppages, outbreaks, or extreme weather) (90days for outside of country events) that are not the fault of theGCepxerience and make it difficult or impossible to carry out the Journey normal business. When a journey is canceled by theGCexperience for any reason other than if by Client request, the Client can either:

  • Transfer deposit to another experience within the next 12 months, or:

  • Receive a full refund of all monies paid under this Agreement as soon as possible.

theGCexperience is not responsible for any incidental expenses or consequential losses that the Client may have incurred as a result of the booking such as visas, vaccinations, non-refundable flights or rail, non-refundable car parking or other fees, loss of earnings, or loss of enjoyment, etc.

If the Client is offered a refund but requests an alternate Journey of a higher value than originally booked, The Client will be responsible for paying the difference in price.

Where after departure a significant element of the trip contracted for cannot be provided, theGCexperience will make suitable alternative arrangements for the continuation of the trip. If it is not possible to provide a suitable alternative or The Client reasonably rejects any suitable alternatives, theGCexperience will provide the Client a refund of unused journey portions.

If a significant alteration or cancellation occurs which is not due to Force Majeure or other circumstances beyond the theGCexperience control, theGCexperience will in some circumstances offer compensation at its sole discretion. Significant alterations do not include the substitution of a transportation method, modification of itineraries, change in hotel accommodation or meal offering.

If a Journey in progress must be interrupted or cancelled, theGCexperience’s liability shall be strictly limited to refund of the recoverable cost of any unused portion of the Journey.

SECURITY DEPOSIT

For private group rentals, all payments will include a non-refundable security deposit. The deposit is required in order to confirm your booking. Non-refundable deposit amounts vary depending on the type of experience you are booking. Deposits range between $200-$500 and will be outlined in each package.  The remaining balance is due thirty days prior to the event. Should you be faced with unforeseen circumstances and have to cancel your attendance, we will work with you to minimize the financial impact on you as much as we can.

ITINERARY SUBSTITUTION

We will make every reasonable effort to keep the Itinerary as published; however, the final Itinerary may vary due to availability and factors beyond our control. We may in our sole discretion substitute services and goods (including accommodations) for goods of similar quality for any service or good stated in the Itinerary. If a Journeys special guests speaker cancels, theGCexperience will make every effort to find a replacement. You will not be refunded in whole or in part when the theGCexperience is unable to find a replacement speaker.

CODE OF CONDUCT

theGCexperience is an inclusive, non-judgemental, laid back, drama-free, relaxed, respectful and safe environment for ALL. theGCexperience and its guests will respect each others’ individuality and will not discriminate or judge one another including: body figure, age, race, sexual orientation and political views. The Client is responsible for respecting the authority and directions of theGCexperience Host. The Client agrees to respect all laws of the country in which they are visiting. We may exclude a guest from participating in all or any part of the experience, in our sole discretion, their condition or behavior renders them unfit for the Journey or unfit for continuation once the Journey has begun. Unfitness may include, without limitation, any behavior that, regardless of its cause, is inappropriate or offensive or interferes with the delivery of Journey services or may constitute a hazard or danger to other participants. In such case, our liability shall be strictly limited to refund of the recoverable cost of any unused portion of the Journey. Should you decide for any reason not to participate in certain parts of the Journey or use certain goods included in the Journey, no refunds will be made for those unused parts of the Journey or goods.

You agree to indemnify and hold us harmless from and against any costs, damages, losses or liabilities arising out of (a) the actions or omissions of any minors traveling with you and who are under your care and control.

MEDICAL CONDITIONS + SPECIAL REQUIREMENTS

The Client must notify theGCexperience in writing of any medical, mental and or physical conditions which may affect or increase risks associated with The Client’s travel and participation to our events and services. Failure to notify theGCexperience may result in the Client being refused travel or services. Failure to notify theGCexperience of any such condition that results in cancellation will be non-refundable.

theGCexperience is not required to provide any special facilities unless it has agreed to do so in writing. theGCexperience mandate and goal is the clients’ experience and will do its best to meet clients’ special requests including dietary, but such requests do not form part of the Contract and therefore theGCexperience is not liable for not being able to fulfill these requests. Medical facilities vary from place to place and theGCexperience makes no representations and gives no warranties in relation to the standard of medical treatment in the locations where the Journey will take place.

INSURANCE (TRAVEL, CANCELLATION & MEDICAL)

Life can be unexpected, and insurance can protect your investments. Our goal is to provide you a memorable experience while keeping you safe should any unforeseen circumstances occur. Although theGCexperience is fully insured, it is the guest’s responsibility to gain their own travel, medical and cancellation insurance to protect themselves of any unforeseen expenses.

  • Although, there is no local requirements for Local travelers do not require travel and medical insurance however we highly recommend it.

  • Out of country travelers are required adequate out of country medical insurance. Proof of medical is insurance will be required for all out of country travels. We recommend Clients obtain travel medical insurance with a minimum medical coverage of $100,000. This insurance must cover personal injury and emergency medical expenses.

It is strongly recommended the coverage be extended to include cancellation, curtailment, and all other expenses that might arise as a result of loss, damage, injury, delay or inconvenience occurring to the Client during travel. theGCexperience shall have no liability for loss, theft of or damage to baggage or personal effects. Personal belongings lost or stolen while unattended by the client in public lounges or other public areas, whether on board a train, bus, or other mode of transportation, publicly owned or operated by theGCexperience or elsewhere, are not reimbursable. Losses due to ordinary wear and tear, and other acts of God are not reimbursable. theGCexperience cannot accept responsibility for and in no event shall be liable for loss or damage of valuables or other articles left in or on facilities used by theGCexperience such as but not limited to hotels, huts, expedition vehicles, boats or any other mode of transportation.

The Client acknowledges that the cost of theGCexperience Journeys do not include insurance and that the Client has been advised to obtain separate coverage at an additional cost. When obtaining travel insurance the Client must ensure the insurer is aware of the type of travel to be undertaken.

Any questions about what travel insurance does or does not cover should be addressed directly to the travel insurance company. If you decline insurance coverage, you will personally assume full responsibility for any financial loss associated with your travel arrangements, and you could lose your travel investment and/or have to pay more money to correct the situation.

TRAVEL DOCUMENTS

Valid Passport: The Client must be in possession of a valid passport required for entry, departure and travel to the Journeys destinations. All visas, permits and certificates including vaccination certificates (if required), insurance policies, etc. which are required for the whole of the Journey are the Client’s sole responsibility and must be obtained prior to the start of the retreat and is solely responsible for any adverse consequences resulting from missing or defective documentation. Any information or advice given by theGCexperience regarding visas, vaccinations, climate, clothing, baggage, special equipment, etc. is purely advisory, and is provided as a courtesy to the Client. theGCexperience is not responsible for any errors or omissions as to the information provided by third parties such as the appropriate governmental authorities.

You are solely responsible for complying with passport, entry and exit, and visa requirements. For U.S. travelers, international travel requires a passport valid six (6) months beyond your intended return travel date. Many destinations require visas be obtained prior to travel. It is recommended that you inform yourself of the most recent passport and visa requirements upon booking.

SHARED ACCOMMODATIONS | ROOMMATE

Friends traveling together will share accommodations unless private accommodations have been reserved. Please ensure to clearly indicate the full names of those traveling with you on your booking form.

Guests travelling solo reserving a double accommodations package will be partnered together. theGCexperience will do their best to match you with the perfect match however we are not responsible for issues that might arise. That being said your Host will do their best to alleviate any issues that arise or reassign roommates when possible.

GRATUITIES

Gratuities for any included meals are included. When travelling abroad that offers external services (such as driver and tour director, waiters etc.) it is customary to show your appreciation based on the level of service received. Gratuities are always at the discretion of the traveler.

AIRFARE

All theGCexperience Journeys do not include national or international airfare. theGCexperience strongly recommends you wait until the trip is confirmed to run before booking airfare or making any non-refundable travel arrangements.

CLAIMS & COMPLAINTS

Although the Client’s experience and satisfaction are theGCexperience top priority, it could happen that a client faces circumstances which impact their satisfaction. If a Client has a complaint during a Journey for any reason whatsoever, the Client must first inform the Journey Host at the earliest opportunity to allow the grievance to be rectified. If satisfaction is not reached, the guest is asked to contact theGCexperience President and CEO while on the Journey to rectify the matter immediately. If you fail to communicate your dissatisfaction during the Journey, this will result in your forfeiting your ability to claim from theGCexperience after the Journey is complete. If satisfaction is still not reached through these means on the Journey, then any further complaint must be put in writing to theGCexperience within 30 days of the end of the trip.  

CLIENT RESPONSIBILITY

The Client acknowledges he or she will be visiting places where the political, cultural and geographical attributes present certain risks, and physical challenges greater than those present in her daily life. By booking travel with theGCexperience, the Client acknowledges she has considered the potential risks, dangers and challenges, and expressly assumes the risks related to such travel conditions. The Client is solely responsible for acquainting themselves with different geographical areas, weather conditions, physical challenges, and laws in effect along the itinerary, and is encouraged to make contact with her family or friends regarding the trip destination. Any questions about the Journey should be directed to theGCexperience well ahead of the Departure Date.

QUALIFIED PROFESSIONAL SERVICES

In order to make our journeys just right for you, theGCexperience may license qualified professionals to provide services during the Journey (workshops, massage therapy, Yoga instructor, activities, outings etc.). Any such designated professional, its company, its parent, subsidiaries, and assigns, and their respective employees, affiliates, officers, directors, successors, representatives, agents, assigns and consultants (collectively “Professional Service Providers”), acts only as an agent for supplying a service (as defined below).

theGCexperience, its subsidiaries, affiliates, and assigns, and their respective employees, officers, directors, successors, representatives, and agents (collectively the “Released Parties”) and the Professional Services will not be held liable for (A) any damage to, or loss of, property or injury to, or death of, persons occasioned directly or indirectly by an act or omission of any Suppliers, including but not limited to any defect in any aircraft, watercraft, or vehicle operated or provided by such Other Provider; and (B) any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other causes beyond their control. The participant waives any claim against the Released Parties and/or the Professional Service Providers for any such loss, damage, injury, or death. theGCexperience acts only as the Journey sponsor and is not responsible for the acts or omissions of other parties. theGCexperience and the Professional Service Providers are collectively referred to as “we or “us”.

SUPPLIERS & INDEPENDENT CONTRACTORS

Hotels, shuttle services, excursions, or other elements of a theGCexperience Journey will be arranged with local suppliers who may themselves engage the services of local operators and/or sub-contractors. theGCexperience will endeavor to appoint reputable and competent local suppliers. The terms and conditions of the suppliers will apply. These may limit or exclude the liability of the supplier. The liability of theGCexperience will not exceed that of any supplier. Local laws and regulations of the relevant country will be relevant in assessing the performance of the services of any supplier. Neither theGCexperience nor any carrier is liable for any third party suppliers used during the Journey.

EXCLUSIONS (OUT OF COUNTRY)

Prices exclude:

  • Airfare (National & International),

  • Airport departure taxes (unless otherwise noted)

  • Transportation to and from the Journey (unless otherwise specified);

  • Travel insurance,

  • Costs associated with obtaining passports or entry visas;

  • Excess baggage charges;

  • Gratuities to the drivers, guides and Professional Service Providers;

  • Meals other than those specified in the Itinerary;

  • Sightseeing not included in the Itinerary;

  • Personal expenses such as laundry, communication charges and optional activities (which are subject to availability).

SAFETY & TRIP ENJOYMENT

We take your safety and well-being very seriously, which is why we partner with licensed companies and other trained professionals for our journeys. However, you are ultimately responsible for your safety, which is why we ask all journey participants to sign a liability waiver before departure. To avoid possibly dangerous situations, it is extremely important that you obey rules and regulations imposed by the theGCexperience Journey Host and instructions given by them.

theGCexperience reserves the right to prohibit any Client from continuing on a trip with no right of refund if, in our opinion, that Client’s actions pose a threat to the safety of them, others, or to the wildlife, or if that Client’s actions or behaviors are seriously jeopardizing the enjoyment of the trip for others. The decision of the theGCexperience or its representative will at all times be final on all matters likely to affect the safety and well-being of the trip. All Clients must, at all times, strictly comply with the laws, and regulations of all cities and or states visited, and theGCexperience will not accept responsibility or liability for any Client who contravenes any laws or other regulations of any place visited.

HEALTH & FITNESS

Most journeys are not overly strenuous for people who are healthy and reasonably fit (unless otherwise specified). All travelers are expected to carry their own bags, maneuver stairs, and be able to walk on outdoor pathways. If you are affected by any condition, medical or otherwise, that might affect your or other people’s enjoyment of the trip, you must advise us of this at the time of booking. If your health or fitness changes between the time of booking and the trip departure date, you must notify the theGCexperience office of these changes before the trip starts.

PHOTOGRAPHY

In the course of participation in a theGCexperience journeys and events, photos or video may be taken by participants or guides. These images may be used in any theGCexperience materials, website, Facebook, etc., unless Clients specifically request to the photographer or in writing to theGCexperience, to not use any material the Client is depicted in. Otherwise, a perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes is granted to theGCexperience.

DATA PROTECTION

To ensure that the journey runs smoothly, theGCexperience may need to use personal information (such as name, dietary requirements etc.) provided by Clients to theGCexperience, and also pass on such information to other guides or suppliers involved in the operation of the trip. theGCexperience will apply appropriate security measures to protect such personal data and will only pass on data that is applicable to guides or suppliers responsible for the retreat. By completing the theGCexperience Journey Booking Form, Clients consent to this information being transferred as required.

LIABILITY

theGCexperience is not responsible for any improper or non-performance of any services forming part of the Journey which are wholly attributable to the fault of the Client, the unforeseeable or unavoidable act or omission of a third party unconnected with the provision of any services to be provided under this Agreement Contract; unusual and unforeseeable circumstances beyond the control of theGCexperience and/or the relevant supplier, the consequences of which could not have been avoided even if all due care had been exercised including (but not limited to) an event of force majeure; or any event which theGCexperience and/or the relevant supplier could not even with all due care have foreseen or forestalled.

In the event that theGCexperience is responsible for any death, injury or illness caused by the negligent acts and/or omissions of its suppliers of services which form part of the Contract then theGCexperience limits its liability.

ACCEPTANCE OF RISK

The Client acknowledges that the nature of the retreat is adventurous and may involve a significant amount of personal risk. The Client hereby assumes all such risk and does hereby release theGCexperience from all claims and causes of action arising from any damages or injuries or death resulting from these inherent risks. At the time of payment, the Client is required to sign theGCexperience RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT. Please read carefully.

SEVERABILITY

In the event that any term or condition contained herein is unenforceable or void by operation of law or as being against public policy or for any other reason than such term or condition shall be deemed to be severed from this Agreement or amended accordingly only to such extent necessary to allow all remaining Terms and Conditions to survive and continue as binding.

SUCCESSORS AND ASSIGNS

These Terms and Conditions shall inure to the benefit of and be binding upon theGCexperience and the Client and their respective heirs, legal personal representatives, successors and assigns.

The Company, theGCexperience exists under, and is pursuant to, the laws of the Province of Ontario, Canada.

APPLICABLE LAW

The Contract and these Terms and Conditions are subject to the laws of the Province of Ontario, Canada.

WAIVER OF BOOKING CONDITIONS

These Booking Terms and Conditions may only be waived or amended by written mutual consent. When a Client completes and submits the Journey Booking Form, they confirm having read these Terms and Conditions, and accepts these Terms and Conditions. When the booking is accepted, theGCexperience agrees to carry out the obligations as defined therein.

OTHER TERMS AND CONDITIONS

YOUR AGREEMENT

By using this Site, you agree to be bound by, and to comply with, these Terms and Conditions.

This Site may contain links to other independent third-party Web sites (“Linked Sites”). These Linked Sites are provided solely as a convenience to our visitors. Such Linked Sites are not under our control, and we are not responsible for and does not endorse the content of such Linked Sites, including any information or materials contained on such Linked Sites. You will need to make your own independent judgment regarding your interaction with these Linked Sites.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

This site may contain inaccuracies and typographical errors. We do not warrant the accuracy or completeness of the materials or the reliability of any advice, opinion, statement or other information displayed or distributed through the site.
